Terms of Service

1. Eligibility & accounts
- You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account.
- Information you enter about an infant or child must be entered by that child’s parent or legal guardian, or by a caregiver authorised by them.
- You are responsible for keeping your account credentials confidential and for any activity that occurs under your account. Notify us promptly at adph.support@previseit.com if you suspect unauthorised access.
- Information you provide at sign-up must be accurate and kept up to date.
2. Purpose of the Service
The Service is provided as a public-health resource by ADPH to:
- Deliver age-appropriate vaccine schedules, milestone reminders, and infant-safety educational content.
- Surface county-specific local resources (e.g. car-seat inspection stations, clinics).
- Provide the Back Seat Alert reminder feature.
- Allow ADPH-authorised administrators to manage the content delivered through the mobile app.
3. Licence to use the Service
ADPH grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the Service on a device you own or control, solely for your personal, non-commercial use and in accordance with these Terms. All other rights are reserved.
4. Permitted & prohibited use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorised access to the Service, other users’ accounts, or our infrastructure.
- Probe, scan, or test the vulnerability of the Service without prior written authorisation.
- Interfere with or disrupt the Service, including by sending viruses, denial-of-service traffic, or excessive automated requests.
- Reverse engineer, decompile, or disassemble any part of the Service except where such restriction is prohibited by law.
- Use the Service to upload content that is unlawful, infringing, defamatory, harassing, or that contains another person’s private information without consent.
- Use the Service to provide medical advice to third parties.
5. Back Seat Alert disclaimer
The Back Seat Alert (“BSA”) feature uses your device’s location, motion sensors, and OS-provided activity recognition to estimate when a drive has ended, and then surfaces an in-app reminder to check the back seat of your vehicle.
You acknowledge and agree that:
- BSA is a reminder aid only. It is not a child-presence sensor, occupant-detection system, or certified safety device.
- BSA depends on factors outside our control, including but not limited to: location service accuracy, sensor calibration, operating-system background-execution limits, battery optimisation settings, “Do Not Disturb” / silent modes, third-party battery-saver apps, network availability, and OEM-specific power-management behaviour. Any of these may cause an alert to be delayed, suppressed, or not delivered at all.
- BSA will not function if you revoke any of its required permissions (background location, notifications, exact alarms, physical activity), if you force-stop or uninstall the app, or if your device is powered off, in airplane mode, out of battery, or otherwise unable to run background services.
- You must always physically check the back seat every time you leave your vehicle. Do not rely on BSA, any other reminder app, or any other device as your sole means of preventing a child or pet from being left in a vehicle.
- ADPH disclaims any and all liability for harm arising from a missed, delayed, or otherwise non-delivered BSA alert. See Sections 11 and 12.
6. Health information disclaimer
Content in the Service — including vaccine schedules, milestone checklists, quizzes, and educational articles — is provided for general informational and public-health-education purposes only. It is not medical advice and is not a substitute for consultation with a qualified healthcare professional. Always consult your child’s pediatrician for advice specific to your child’s health.
If you believe your child is experiencing a medical emergency, call 911 or your local emergency number immediately.
7. User-provided content
You retain ownership of the information and images you upload to the Service (“Your Content”). You grant ADPH a limited, worldwide, royalty-free licence to host, store, transmit, and display Your Content solely as needed to operate the Service for you. We will not sell Your Content or use it for advertising.
8. Third-party services
The Service relies on third-party providers (including Supabase, Google Firebase, Google Sign-In, Sign in with Apple, hCaptcha, and the Google Play and Apple App Store distribution platforms). Your use of any third-party service is subject to that provider’s own terms. We are not responsible for third-party services or content. The list of providers is described in our Privacy Policy.
9. Availability & changes
The Service is provided on an as-available basis. We may update, add, modify, or remove features at any time without prior notice, including to comply with policy or law. We may also schedule downtime for maintenance.
10. Termination
- By you: you may stop using the Service at any time and may delete your account from Profile → Settings → Delete Account inside the mobile app, from our account deletion request page, or by emailing us.
- By us: we may suspend or terminate your access if you breach these Terms, if your account is used in a way that endangers other users or the Service, or if we are required to do so by law. Where reasonable, we will give you notice and an opportunity to cure.
- Sections that by their nature should survive termination (including 5, 6, 11, 12, 13, and 14) survive termination of these Terms.
11. Disclaimer of warranties
The service is provided “as is” and “as available”, without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, ADPH disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
Without limiting the above, ADPH does not warrant that the Back Seat Alert or any notification will be delivered on time, in full, or at all.
12. Limitation of liability
To the maximum extent permitted by law, ADPH and its officers, employees, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, use, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the service — including any reliance on or failure of the back seat alert feature.
Nothing in these Terms limits any liability that cannot lawfully be excluded.
13. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ADPH and its personnel from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.
14. Governing law
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Alabama, United States, and you consent to the jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you through the Service or by email before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
